Terms of Agreement

This Membership Agreement shall be governed and construed in accordance with the laws of Scotland and the parties hereby prorogate the exclusive jurisdiction of the Scottish Courts.

This Membership Agreement sets out the terms and conditions of Membership of the University of Glasgow Sport and Recreation Service Facilities and incorporates the SRS Rules. Membership is subject to these terms and conditions and is at all times conditional on the Member abiding by the SRS Rules.

Meaning of Terms

Category a category of membership described more fully on the website

Facilities premises and equipment provided by GU from time to time

Member a person who has paid the relevant Fee in order to use the GU Sport and Recreation Service Facilities in accordance with their Membership Category and “Membership” shall be construed accordingly

Premises collectively the sports centres and playing fields provided by GU from time to time

SRS Sport and Recreation Service of GU

SRS Rules the rules and regulations published from time to time by GU

Vacation Periods the vacation periods determined by GU on an annual basis.

membership, fees and hire

1 GU reserves the right to accept a Member at its sole discretion.

2 GU reserves the right to refuse entry to the Premises by any Member or former Member whose Membership has been suspended or terminated.

3 Membership is personal to a Member and may not be assigned, transferred or otherwise disposed of.

4 Every Member will be issued with a Membership card which shall remain the property of GU and which is strictly non-transferable. Any Member may be asked at any time to produce their Membership card and must do so. If a Member is unable to produce their Membership card or other proof of identity which is satisfactory to GU, GU reserves the right to refuse admission or to eject the Member from the Premises.

During the Membership Year, in the event that a Member is unable to produce their Membership card then (a) in respect of the first three occasions when they fail to do so, GU reserves the right to refuse admission regardless of ability to produce alternative proof of identity; and (b) in respect of each subsequent occasion when they fail to do so, GU reserves the right at its sole discretion to refuse admission regardless of ability to produce alternative proof of identity or to require payment of a charge in order to obtain admission.

5 It is a members responsibility to take care of their Membership card. Access will only be given on production of a functioning Membership card. Membership will be suspended until a replacement Membership card is purchased. A fee is required for replacement Membership cards.

6 Loss or theft of a Membership card must be reported to the SRS immediately and GU reserves the right to charge a nominal fee for the replacement of any Membership card.

7 In advance of each Membership Year, GU shall write to the Member and confirm the Fees which will be payable by the Member in that forthcoming Membership Year. Should the Member wish to cancel their Membership, this may be done in accordance with clause 15.

8 All bookings must be paid in full 7 days in advance.

9Any Member wishing to book any Facilities must produce their Membership card when booking.

10 The use of certain Facilities is subject to payment of a charge in addition to the Fee. A list of charges is available from the SRS. GU reserves the right at any time to change the Fees and charges at its discretion.

11 The SRS may cancel any booking made by a Member at any time. Where possible, GU will give as much notice of such cancellation as is reasonably practicable.

12 Bookings of the Facilities must be cancelled with no less than 48 hours notice before the booking, otherwise the full charge for the Facilities will be due and payable.

13 Where a Member hires an item, the relevant deposit must be left at the SRS reception area. The deposit will be forfeited if the hire item is returned damaged or if it is not returned. A further charge may be levied by GU in the event that the deposit is insufficient to cover the actual cost of repair or replacement of the item.

14 Members shall be liable for the cost of any damage or loss (including theft) caused to the Facilities, by them or their guests (fair wear and tear excepted).

term and termination

15 Membership shall subsist from the date on which the Membership commences until an event of termination in accordance with this Agreement.

16 Where a Member pays Fees by payroll deduction and for any reason ceases to be employed by GU, his/her Membership shall automatically terminate at the end of the month in which the Member’s employment ceases.

17 Where Fees are paid payroll deduction, the Member may cancel their Membership by giving GU not less than one month’s notice in writing which must be received by GU prior to the beginning of the month from which notice is due to run. Where the Membership Category requires it, GU will refund the proportion of the Fee applicable to the unused period of the Membership.

suspension and cancellation

18 GU reserves the right at its sole discretion and at any time to cancel or suspend the Membership of any Member with immediate effect in the event that the Member or any of the Member’s guests commit a serious breach of this Membership Agreement and the breach if capable of remedy, is not remedied within 7 days of receipt of a notice advising the Member of such serious breach particularly where:

(a) the Member or his or her guests fail to obey notices and signs in the Premises or the instructions of SRS representatives;

(b) the Member or his or her guests’ breach any of the SRS Rules;

(c) the Member or his or her guests’ conduct is improper or likely to endanger the welfare, safety, harmony, staff or reputation of GU or to compromise the reasonable enjoyment of others;

(d) the Member is shown to have provided GU with false or misleading information for the purposes of gaining Membership for him, her or any other person; or

(e) any amounts due and owed to GU by the Member have not been paid within 14 days following the date of a written notice of the amount due;

(f) the Member allows another person to use his Membership card to access the Premises; or

(g) a member brings any person on to the Premises on an unauthorised basis.

guests

19 In exchange for the payment of the relevant charge, a Member may sign-in up to 3 adult guests (16 years or over) on any one visit during weekends and Vacation Periods only. In addition, each Member and each guest may sign-in up to 2 children on any one visit during weekends and Vacation Periods only.

20 Members are responsible for ensuring that (a) they accompany their guests at all times whilst on the Premises; and (b) their guests obey the SRS Rules and the instructions given to them by any SRS representative.

21 Children must be accompanied by an adult at all times. Children are not permitted in the muscle conditioning and cardiovascular areas, sauna and steam room and may not participate in any group exercise programme.

22 GU reserves the right to refuse entry or to eject from the Premises any non-member who is not properly admitted as a guest in accordance with this Membership Agreement.

23 In accepting Membership, the Member warrants and represents that, so far as the Member is aware, the Member is in good physical condition and is capable of all forms of exercise and that such exercise would not be detrimental to his/her health.

24 In signing-in a guest or child, the Member warrants and represents that, so far as the Member is aware, the guest or child is in a physical condition suitable for the type of exercise or activity in which the guest or child engages on the Premises.

25 Without in any way limiting the scope and effect of the Member’s warranty given in clauses 19 and 20 above, the Member is responsible for bringing to the attention of GU any medical condition that may present a risk to a Member and/or a Member’s guest or a child in engaging in any particular activity or exercise.

liability

26 GU’s liability for damage to or loss (including theft) of Members’ or guests’ property, including theft or loss of items from lockers, is strictly limited to damage or loss suffered as a result of the negligence of GU, its staff or agents.

27 GU will not accept any liability for any accident or injury (including any fatality) to any Member, guest, child or visitor that may occur on the Premises other than liability which may arise from the negligence of GU, its staff or its agents. All such incidents must immediately be reported to a SRS representative.

28 Valuables, clothing and personal items should be stored in the lockers provided. Lockers are provided on a daily basis only and items left overnight will be removed and treated as lost property (except where a Member has paid the charge for annual locker hire). Items left in lockers at the expiry of an annual locker hire period will be removed and treated as lost property.

29 All items of lost property are logged and will be held on the Premises for no more than two weeks. Thereafter, unclaimed items will be passed to the police.

30 GU operates CCTV and similar equipment to monitor safety and security and may monitor telecommunications, data communications and other communications as permitted by relevant legislation.

31 GU collects and processes personal information, including images, of its Members and potential Members for processing Membership applications, managing and administering Memberships, health and safety reasons, to provide services and to provide information about other SRS services and forthcoming activities to Members. GU shall process such information in accordance with the Data Protection Act 1988. If any Member does not wish to receive information about other SRS services and forthcoming activities, that Member should inform GU by notifying the SRS customer service manager.

Members are responsible for advising GU as soon as practicable of any changes to their personal details.

32 Where a Member is also a matriculated student or employee of GU, nothing in this Membership Agreement shall operate to limit the effect of such other terms and conditions of matriculation or employment as may exist between the Member and GU.

33 GU reserves the right to prevent entry into or reject from the Premises anyone whose behaviour or appearance is, in its sole opinion, deemed by it to be unsuitable.

34 GU reserves the right to add, change or provide suitable alternative Facilities and may also at any time withdraw all or part of such Facilities for any period(s) where they are required for tournaments or other activities or in connection with any repair, alteration or maintenance work.

35 GU reserves the right at any time to adjust opening hours for all or any part of the Facilities.

36 GU may alter, amend or add to the SRS Rules at any time. Alterations, amendments and additions to the SRS Rules will be posted in the Facilities which will constitute due notice of such changes.

37 GU reserves the right to show visitors, potential members and other individuals the Facilities.

38 Neither the Member or GU shall be deemed to be in breach of this Membership Agreement by reason of any delay in performing, or any failure to perform, any of their respective obligations if the delay or failure was due to any cause beyond the Member’s or GU’s reasonable control, including but not limited to,acts of God, explosions, actual or suspected terrorist attacks, floods, fire or accident, war or threat of war, sabotage, civil disturbance, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, import or export regulations or embargoes or industrial actions or trade disputes.
